BLHP may verify your identity through OTP (One-Time Password) sent to your registered mobile number or e-mail. This is required to access your account securely.

If permitted by your device settings, the app may auto-detect and fill in the OTP to simplify the login process. This feature is optional and requires your explicit consent via system permissions.

If you suspect any unauthorized use of your account, you agree to immediately notify us at blhp@blhp.in.

Use of Our Services

Mobile Application (ios and android): By using the BLHP mobile application, you agree to allow access to necessary features such as GPS for location-based services, notifications, and OTP-based login. All data usage complies with our Privacy Policy.

BLHP is committed to maintaining a secure and compliant platform. We may conduct periodic audits and assessments to ensure data security, app reliability, and regulatory compliance.

You agree to use the Services only for lawful purposes and in a manner that does not infringe the rights of others or violate any applicable laws. You are prohibited from using the Services to:

• Engage in any illegal, fraudulent, or harmful activities.
• Impose an unreasonable burden on our infrastructure.
• Harass, defame, or threaten others.

Content Ownership and Usage

All content available through the Services, including text, images, logos, trademarks, and other materials, is the property of BLHP or its licensors and is protected by copyright and intellectual property laws. Donations and Payments

If you choose to make a donation to BLHP, you agree to provide accurate and complete payment information. All donations are final and non-refundable, except as required by law. We reserve the right to process donations through third-party payment processors, and your payment information will be governed by the privacy policy of such processors.

Offers

BLHP may offer BLHP Points or E-Money as part of pre-launch and promotional programs. These can be used to unlock exclusive benefits, such as added discounts on future purchases through the platform. While these points may hold value within BLHP, they are not real currency, non-transferable, and subject to terms defined by the organisation.

 Volunteer and Beneficiary Engagement

For those who engage with BLHP as volunteers or beneficiaries:

• Volunteers agree to contribute time and effort in a manner that is consistent with the mission and goals of BLHP.
• Beneficiaries agree to provide truthful information and participate in the programs offered by BLHP in accordance with the eligibility criteria set by the organization.

Disclaimer of Warranties  

BLHP provides the Services “as is” and “as available,” without any warranties or representations of any kind, whether express or implied. We do not guarantee the accuracy, reliability, or availability of the Services, nor do we warrant that the Services will be free from errors or interruptions.

Limitation of Liability

To the fullest extent permitted by law, BLHP shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Services, including but not limited to any loss of data, loss of profits, or business interruption.

To the fullest extent permitted under applicable law, Better Life Happier People (BLHP), its trustees, officers, employees, affiliates, or service providers shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from your use of the services – including, but not limited to, loss of data, loss of profits, system failure, or business interruption.

Users are encouraged to exercise independent judgment before acting on any information provided. BLHP does not assume responsibility for actions or decisions taken by users. Our role is to facilitate safer buying decisions through community knowledge, guidance, and transparency not to guarantee the outcome of any transaction.

Indemnification

You agree to indemnify and hold BLHP, its affiliates, officers, directors, employees, and agents harmless from any claims, liabilities, losses, damages, or expenses (including legal fees) arising out of your violation of these Terms of Use or your use of the Services.

You agree to indemnify, defend, and hold harmless Better Life Happier People (BLHP), its affiliates, trustees, officers, employees, volunteers, and authorized agents from and against any and all claims, demands, liabilities, losses, damages, penalties, or expenses arising out of or related to:

• Your use or misuse of the BLHP platform, website, or mobile application;

• Any misrepresentation, negligence, or unlawful act by you in connection with your use of our services.

BLHP reserves the right to suspend or terminate your access to the Services at any time, without notice, for conduct that we believe violates these Terms of Use or is harmful to other users or the operation of the Services.

BLHP reserves the right to suspend, restrict, or permanently terminate your access to the platform or any of its services at its sole discretion, without prior notice, if:

• You are found to be in violation of these Terms of Use, Privacy Policy, or any applicable BLHP policy;
• Your actions are deemed harmful to other users, the integrity of the platform, or the values of the organization;
• Required by law enforcement or legal obligations;
• There is suspected misuse, fraud, impersonation, or unlawful activity associated with your account.

Governing Law and Dispute Resolution

These Terms of Use are governed by and shall be construed in accordance with the laws of India.

Any dispute arising out of or in connection with these Terms of Use or the Services shall first be attempted to be resolved through amicable negotiation between the parties. If the dispute cannot be resolved through negotiation, the parties agree to submit the dispute to arbitration. The arbitration will take place in New Delhi, India, and will be conducted in English, in accordance with the rules of the Emerging Businesses Chamber of Commerce (“EBCC”). The arbitration shall be conducted by a Sole Arbitrator, who will be nominated by the President of EBCC.

The place of arbitration shall be New Delhi, India, and the language of the arbitration proceedings shall be English. The decision of the arbitrator shall be final, conclusive, and binding on both parties.

In relation to this Clause, including the arbitration agreement, the parties agree that the exclusive jurisdiction for any legal proceedings shall lie with the courts located in New Delhi, India.
